TERMS AND CONDITIONS OF USE AND LICENSING
1. Scope and Acceptance
1.1 These Terms and Conditions govern access to and use of the online music library “tv-essential” (the “Platform”), operated by Feed Me Music OHG, registered with the Local Court of Hamburg under HRA 94999 (the “Provider”), accessible at hello@tv-essential.com.
1.2 The Platform is made available exclusively to business users, being individuals or entities acting in the course of a trade, business, craft or profession (“Users”). Consumers may only access the Platform subject to a separate written agreement with the Provider.
1.3 By accessing or using the Platform, the User:
agrees to be bound by these Terms in their current version; and
warrants that it is acting as a business user.
1.4 Any terms and conditions of the User shall be excluded unless expressly agreed in writing by the Provider.
2. Use and Licensing
2.1 The platform allows users to search for music in a database, listen to it, and download it in MP3 format.
2.2 The use of music in productions by television and radio stations that have a framework agreement with GEMA and GVL does not require an additional license from the Provider.
2.3 For all other uses (e.g., in commercials or on social media platforms), the user must submit a licensing request to the Provider at hello@tv-essential prior to use. The most recent version of the price list applies. After reviewing the application, the provider will issue a license offer, which becomes valid upon payment of the license fee; only then is use permitted.
2.4 Uses of any kind require registration with the relevant collecting society. The information required for this (work, author, publisher, label code, GEMA work number, ISRC code) can be requested via the copyright download link in the track section.
2.5 The rights administered by collecting societies (e.g., GEMA, GVL) are not included in the Provider’s licensing.
3. Restrictions of Use
The User shall not, and shall ensure that no third party shall:
3.1 sell, license, distribute, assign, sublicense, or otherwise exploit the Music as a standalone product;
3.2 make the Music available to third parties except as incorporated into a permitted production;
3.3 use the Music in any unlawful, defamatory, obscene, discriminatory or otherwise offensive context;
3.4 use the Music for the purpose of training artificial intelligence or machine learning systems;
3.5 remove or alter any copyright, metadata, or rights management information.
4. Transparency Notes on the Use of Artificial Intelligence
4.1 AI-Generated Image Content
Some of the images used on this website, particularly playlist and cover art, were created in whole or in part using artificial intelligence. These are stylized, illustrative representations intended for presentation and marketing purposes. They do not depict real people, places, or events and make no claim to documentary accuracy. This notice serves to ensure transparency in accordance with Article 50 of Regulation (EU) 2024/1689 (AI Regulation).
4.2 AI-Assisted Music Production
A small portion of the music productions offered via TV-Essential are created using AI-assisted tools during the editing or creation of individual instrumental tracks (stems) in the arrangement. The musical composition itself is always the work of human composers; compositions generated purely by AI are not part of our catalog.
5. Liability
The provider is not liable for damages resulting from the use of the musical works, unless such damages are caused by willful misconduct or gross negligence.
6. Privacy Policy
The collection, processing, and use of personal data are carried out in accordance with the Privacy Policy, which is available on the platform.
7. Final Provisions
7.1 Should any provision of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
7.2 German law applies to all legal matters.
7.3 The place of jurisdiction for disputes is Hamburg.
7.4 In the event of any discrepancies between the German version and a foreign-language version of these General Terms and Conditions, the German version shall prevail.
